Terms of Use

These terms are an agreement between you and LUDICROUS INC (株式会社LUDICROUS) covering your use of ChillCheck. By installing or using the app, you accept them. If you do not, do not use the app.

What ChillCheck is

ChillCheck is a record-keeping tool. It records what you enter and shows it back to you.

You are responsible for the accuracy of what you enter, for the target ranges and schedules you configure, and for deciding what to do about any reading. The app does not make those decisions and does not verify that a reading is correct.

Subscriptions

ChillCheck is free to use in full for 7 days. After that, a subscription is required to keep using it. Plans are Monthly (billed every month) and Annual (billed every year). The price of each plan is shown on the purchase screen in the app, in your local currency, before you buy.

• Payment is charged to your Apple or Google account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period, at the same price, unless you cancel.
• To cancel, turn off auto-renewal in your store account settings at least 24 hours before the current period ends. Cancelling stops the next charge; you keep access until the period you have paid for runs out.
• Deleting the app does not cancel a subscription. Cancel it in the store.

Refunds

Purchases are made through Apple and Google, and only they can issue refunds. We cannot reverse a charge. If something went wrong, tell us at support@ludicrous.co.jp — we will help where we can, and we would rather know than not.

Your records

Your records belong to you. They are stored on your device, not with us, which also means we cannot recover them for you. If you lose the device, uninstall the app, or clear its data, the records are gone. Export the months you need to keep.

Acceptable use

Do not attempt to alter the app to misrepresent when a record was entered, and do not use it to produce records of measurements that were not actually taken. The value of these records is that they are honest. Beyond that: do not reverse-engineer, resell, or redistribute the app, except where that restriction is not enforceable under the law that applies to you.

Availability and changes

We may update ChillCheck, change its features, or stop offering it. If we discontinue it, we will not cut short a subscription period you have already paid for. This page and the privacy policy stay available after any such discontinuation.

No warranty

ChillCheck is provided "as is", without warranties of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We do not warrant that it will be uninterrupted, error-free, or that a notification will always be delivered — device settings, power, and operating system behaviour are outside our control. Some jurisdictions do not allow the exclusion of implied warranties, so this may not apply to you.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for lost profits, lost records, regulatory penalties, or the outcome of any inspection. Our total liability is limited to the amount you paid for ChillCheck in the twelve months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you. Nothing here limits liability that cannot be limited by law.

If you installed from the App Store

These terms are between you and us, not Apple. Apple is not responsible for ChillCheck or its content, and has no obligation to provide support for it. Apple is not responsible for addressing any claim you have about the app, including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or privacy law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

Governing law

These terms are governed by the laws of Japan, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live.
