Terms of Use

These terms are an agreement between you and Ludicrous, inc. (株式会社LUDICROUS) covering your use of Segno. By installing or using the app, you accept them. If you do not, do not use the app.

What Segno is

Segno is a recorder. It records what reaches the microphone and gives it back to you.

You are responsible for where you place the phone, for the levels you accept after a soundcheck, and for checking that a recording you submit meets whatever the school or competition asks for. Segno does not check those requirements and does not judge a performance.

Recordings of other people

A recording may contain other people: a teacher, an accompanist, the rest of an ensemble. Those recordings stay on your device and we never receive them, so obtaining permission to record, and deciding what to do with the file afterwards, is yours.

Subscriptions

Segno is free to use up to Three takes of up to three minutes each, kept as long as you like, with no time limit. Three takes of up to three minutes each, playable in the app. Export and further recording need a subscription, and the annual plan begins with a seven-day free trial. Plans are Annual (billed every year) and Monthly (billed every month). The price of each plan is shown on the purchase screen in the app, in your local currency, before you buy.

• Payment is charged to your Apple or Google account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period, at the same price, unless you cancel.
• To cancel, turn off auto-renewal in your store account settings at least 24 hours before the current period ends. Cancelling stops the next charge; you keep access until the period you have paid for runs out.
• Deleting the app does not cancel a subscription. Cancel it in the store.

Refunds

Purchases are made through Apple and Google, and only they can issue refunds. We cannot reverse a charge. If something went wrong, tell us at support@ludicrous.co.jp — we will help where we can, and we would rather know than not.

Your records

Your records belong to you. They are stored on your device, not with us, which also means we cannot recover them for you. If you lose the device, uninstall the app, or clear its data, the records are gone. Export the takes you want to keep — WAV, ALAC, AAC or MP4 — and save them to Files, AirDrop them, or put them wherever you keep your backups. Takes live inside the app, so deleting the app deletes them.

Acceptable use

Recording other people — a teacher, an accompanist, the rest of the ensemble — is yours to get permission for, and so is following the rules of the hall you are standing in. Do not reverse-engineer, resell, or redistribute the app, except where that restriction is not enforceable under the law that applies to you.

Availability and changes

We may update Segno, change its features, or stop offering it. If we discontinue it, we will not cut short a subscription period you have already paid for. This page and the privacy policy stay available after any such discontinuation.

No warranty

Segno is provided "as is", without warranties of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We do not warrant that it will be uninterrupted, error-free, or that a notification will always be delivered — device settings, power, and operating system behaviour are outside our control. Some jurisdictions do not allow the exclusion of implied warranties, so this may not apply to you.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for lost profits, lost records, regulatory penalties, or the outcome of any inspection. Our total liability is limited to the amount you paid for Segno in the twelve months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you. Nothing here limits liability that cannot be limited by law.

If you installed from the App Store

These terms are between you and us, not Apple. Apple is not responsible for Segno or its content, and has no obligation to provide support for it. Apple is not responsible for addressing any claim you have about the app, including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or privacy law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

Governing law

These terms are governed by the laws of Japan, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live.
